OFFICIAL RULES AND DISCLAIMERS
NO PURCHASE IS NECESSARY TO ENTER OR WIN THE PRIZE IN THE JM BULLION 1 TROY OUNCE GOLD COIN RAFFLE GIVEAWAY (THE “SWEEPSTAKES”). THE SWEEPSTAKES IS OPEN TO ATTENDEES OF THE 2024 NEW ORLEANS INVESTMENT CONFERENCE WHO ALLOW JM BULLION TO SCAN THEIR BADGE AND THEREBY PROVIDE JM BULLION WITH THEIR EMAIL ADDRESS AND OTHER CONTACT INFORMATION, AND CONSENT TO RECEIVE MARKETING EMAILS FROM JM BULLION. A PURCHASE OR PAYMENT WILL NOT INCREASE YOUR CHANCES OF WINNING.
The Sweepstakes is subject to all applicable federal, state, and local laws, and it is Void Where Prohibited. The Eligible Entrant (defined below) who wins the Sweepstakes prize will be responsible for all taxes related to the award thereof. The Sweepstakes begins at 9:00 AM Central Time (CT) on November 20, 2024 and ends at 10:00 PM CT on November 23, 2024 (the “Sweepstakes Period”). Only one (1) winner of the Sweepstakes will be selected. Selection will occur the week following the New Orleans Investment Conference and no later than Wednesday, November 27, 2024, and that winner will receive the one (1) Sweepstakes prize described below. The Sweepstakes is sponsored by JM Bullion, Inc. (the “Sponsor” or “JM Bullion”), whose principal business address is 11700 Preston Road, Suite 660153, Dallas, Texas 75230.
ELIGIBILITY: The Sweepstakes is open to any natural person who is a legal resident of the United States of America, including the District of Columbia, who has reached their eighteenth (18) birthday prior to the end of the Sweepstakes Period, is a registered attendee of the New Orleans Investment Conference, and that permits Sponsor to scan their attendee badge and thereby provide their email address and other contact information to Sponsor and consent to receipt of marketing emails and similar communications from Sponsor (“Eligible Entrants”). Notwithstanding the foregoing, employees of the Sponsor, its advertising and promotion agencies and affiliated entities (such entities collectively being, “Sweepstakes Entities”), and such employees’ immediate families (parent, child, sibling and spouse of any of the foregoing) and persons living in the households of any of the foregoing, whether related by blood or law are not eligible to enter the Sweepstakes and thus are not Eligible Entrants. By entering, each entrant agrees to be bound by these official rules, and the decisions of the Sponsor regarding the Sweepstakes are final and binding in all respects.
TO ENTER: All entries will be received by scanning the attendee’s badge at the 2024 New Orleans Investment Conference and thereby providing the attendee’s email address and other contact information to Sponsor. Through the provision of the email address and other contact information, the Eligible Entrant consents to the receipt of marketing emails and similar communications from the Sponsor. There is a limit of one (1) entry per person. Any Eligible Entrant who successfully scans their badge, or consents to the Sponsor scanning their badge, while at the 2024 New Orleans Investment Conference will be registered for entry to the Sweepstakes.
SELECTION OF WINNER: the Sponsor will conduct a random drawing from among all entries received from Eligible Entrants during the Sweepstakes Period between Monday, November 25 and Wednesday, November 27. The odds of winning are based on the number of entries received from Eligible Entrants. The selected prize winner (“Prize Winner”) will be contacted by e-mail address at the e-mail address provided by the Prize Winner or text message if a cellphone number was provided by the Prize Winner. If the initially selected Prize Winner does not respond within five (5) business days after Sponsor contacts him/her or the Prize Winner fails to return the Affidavit/Release (defined below) in the required time as provided herein, or refuses or is unable to accept the prize, then that initially selected Prize Winner will be deemed to have forfeited his/her prize. The forfeited prize will be re-awarded to an alternative winner by the Sponsor by conducting another random drawing from among the remaining entries received from Eligible Entrants during the Sweepstakes Period (in the manner set forth above in this Section). If the selected alternative Prize Winner does not respond within five (5) business days after Sponsor contacts him/her as the alternative Prize Winner, or fails to return the Affidavit/Release in the required time as provided herein, or refuses or is unable to accept the prize, then that selected alternative Prize Winner will be deemed to have forfeited his/her prize, and Sponsor may donate the prize or its value, at Sponsor’s discretion, to a charity of Sponsor’s choice. Except to the extent prohibited by law, any selected Prize Winner will be required to complete and return an affidavit of eligibility and liability release (the “Affidavit/Release”) within five (5) business days after contacting the Sponsor regarding his/her being a prize winner. If the selected Prize Winner (either initial or alternative) fails to sign and return the Affidavit/Release within the required time period, then the selected Prize Winner (either initial or alternative) will be deemed to have forfeited the prize. Upon receipt of the Affidavit/Release, the prize will be shipped to the address provided on the Affidavit/Release. THE SELECTED PRIZE WINNER IS SUBJECT TO VERIFICATION BY THE SPONSOR, WHOSE DECISIONS ARE FINAL AND BINDING IN ALL MATTERS RELATED TO THE SWEEPSTAKES.
PRIZE: One (1) prize will be awarded in the Sweepstakes. The single Sweepstakes prize will be a one (1) troy ounce gold coin. The Sweepstakes Prize will have a retail value of approximately the “live spot price” for gold on the date of drawing, which is approximately $2,800.00.
PRIZE RESTRICTIONS: Any and all applicable federal, state, and local taxes are the sole responsibility of the individual Prize Winner. The prize cannot be substituted, assigned, transferred, or redeemed for cash. The Sponsor will not replace the prize if it is lost or stolen once delivered to the Prize Winner.
GENERAL CONDITIONS: The Sponsor’s failure to enforce any term of these rules and disclaimers (these “Official Rules”) shall not constitute a waiver of that provision. Neither the Sponsor nor anyone acting on its behalf will enter into any communications with any entrant regarding this Sweepstakes, except as expressly set forth in these Official Rules. The Sponsor reserves the right at its sole and absolute discretion to disqualify any individual it finds to be attempting to tamper with or undermine the entry process, the JM Bullion website, and/or the legitimate operation of the Sweepstakes; to violate these Official Rules; or to act in an unsportsmanlike or disruptive manner or with the intent to annoy, abuse, threaten, or harass any other person with respect to the Sweepstakes. The Sponsor may, in its sole and absolute discretion, void any suspect entries and (a) cancel or terminate the Sweepstakes (or any portion thereof); (b) modify the Sweepstakes or suspend the Sweepstakes to address the impairment and then resume the Sweepstakes in a manner that best conforms to the spirit of these Official Rules; or (c) award the prize at random from among the non-suspect entries received form Eligible Entrants up to the time of the impairment. In addition, Sponsor in its sole and absolute discretion may terminate the Sweepstakes before the end of the Sweepstakes Period. By entering the Sweepstakes, you expressly consent to provide Sponsor with your contact information and to the Sponsor adding you to Sponsor’s mailing list for marketing emails. The Privacy Policy of the Sponsor shall apply to all aspects of the Sweepstakes. The Privacy Policy can be found online at https://www.jmbullion.com/privacy-policy/.
INTERNET CONDITIONS: The Sponsor shall not be responsible for any entries in the Sweepstakes that are not properly entered due to data corruption or otherwise not received correctly, or for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers or providers, computer equipment, software, failure of e-mail, or on account of technical problems or traffic congestion on the internet or at any website or combination thereof, including injury or damage to entrant’s computer related to or resulting from participating in the Sweepstakes. The Sponsor shall not be responsible for any lost, misdirected or late entries into the Sweepstakes. The Sponsor reserves the right to cancel, terminate, modify or suspend the Sweepstakes in the event that the Sweepstakes is not capable of running as planned, including because of infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures or any other causes beyond the control of the Sponsor which corrupts or affects the administration, security fairness, integrity or proper conduct of the Sweepstakes.
RELEASE AND LIMITATIONS OF LIABILITY: BY PARTICIPATING IN THE SWEEPSTAKES, ENTRANTS AGREE THAT SPONSOR, AND ITS PARENTS, AFFILIATES, SUBSIDIARIES, REPRESENTATIVES, CONSULTANTS, CONTRACTORS, LEGAL COUNSEL, ADVERTISING, PUBLIC RELATIONS, PROMOTIONAL, FULFILLMENT AND MARKETING, WEB SITE PROVIDERS, WEB MASTERS AND THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES, AND AGENTS (THE “RELEASED ENTITIES”), WILL HAVE NO LIABILITY WHATSOEVER FOR, AND SHALL BE HELD HARMLESS BY ENTRANTS AGAINST, ANY LIABILITY FOR ANY INJURIES, LOSSES OR DAMAGES OF ANY KIND TO PERSONS, INCLUDING PERSONAL INJURY OR DEATH, OR PROPERTY RESULTING IN WHOLE OR IN PART, DIRECTLY OR INDIRECTLY, FROM ACCEPTANCE, POSSESSION, MISUSE, OR USE OF THE PRIZE, ENTRY, OR PARTICIPATION IN THIS SWEEPSTAKES OR IN ANY SWEEPSTAKES RELATED ACTIVITY, OR ANY CLAIMS BASED ON PUBLICITY RIGHTS, DEFAMATION OR INVASION OF PRIVACY, OR MERCHANDISE DELIVERY. THE RELEASED ENTITIES ARE NOT RESPONSIBLE IF ANY PRIZE CANNOT BE AWARDED DUE TO ACTS OF GOD, ACTS OF WAR, NATURAL DISASTERS, WEATHER, BANKRUPTCY OR TERRORISM. BY PARTICIPATING IN THIS SWEEPSTAKES, PARTICIPANTS AGREE THAT THE RELEASED ENTITIES WILL NOT BE RESPONSIBLE OR LIABLE FOR ANY INJURIES, DAMAGES, OR LOSSES OF ANY KIND, INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES TO PERSONS, INCLUDING DEATH, OR TO PROPERTY ARISING OUT OF PARTICIPATION IN THE SWEEPSTAKES. EVERYTHING REGARDING THIS SWEEPSTAKES, INCLUDING THE PRIZE, ARE PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED.
DISPUTES: Except where prohibited, Eligible Entrants agree that: (a) any and all disputes, claims and causes of action arising out of or connected with this Sweepstakes or the prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the United States District Court for the Northern District of Texas or the appropriate local court located in Dallas, Texas; (b) any and all claims, judgment, and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Sweepstakes, but in no event attorneys’ fees; (c) under no circumstances will Eligible Entrants be permitted to obtain awards for, and entrant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and the Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of Texas, without giving effect to any choice of law or conflict of laws rules (whether of the State of Texas or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Texas.
